Terms of Service
CORRESSA Service Terms of Use (Free Trial)
The CORRESSA Service Terms of Use (Free Trial) (hereinafter referred to as “these Terms”) apply to the customer’s free trial of the Service. By clicking on the checkbox indicating acceptance of these terms on the webpage, the customer agrees to all the conditions of these Terms.
If the customer accepts these Terms by clicking on the checkbox indicating acceptance on the webpage, it is deemed that the customer agrees to the terms on behalf of their company or other corporate entity and has the authority to bind said entity and its affiliates under these Terms. Therefore, if the customer does not have such authority or does not agree to these Terms, they must not accept these Terms and cannot use the Service.
Customers who are direct competitors of the company may not access the Service. Additionally, customers may not access the Service for purposes of evaluating functionality, measuring availability or performance, conducting benchmarking, or competitive analysis.
These Terms become effective between the customer and our company on the date the customer accepts these Terms.

1. Definitions
“The Service” refers to the online applications and platforms provided by our company via the designated website http://www.corressa.com/ or as described in other user guides, offered as a free trial to the customer.
“Free Trial” refers to the trial use of the Service provided free of charge before the customer purchases the paid service, to verify suitability for the customer’s usage purposes, environment, and other conditions.
“Paid Service” refers to the services purchased separately by the customer or the customer’s affiliates under the CORRESSA Terms of Use (Paid Service), distinct from the Service provided under the Free Trial.
“Subscription” refers to the usage rights purchased by the customer from our company, allowing the end-user to utilize the Service within a specified period.
“User Guide” refers to the “Operation Manual” under “Support & Download” on http://www.corressa.com/, which is updated from time to time. The customer acknowledges having the opportunity to review the User Guide during the Free Trial period described in Article 3 (The Service).
“Customer” refers to the company or corporate organization accepting these Terms on behalf of itself or its affiliates referenced herein.
“Affiliate” refers to an entity that directly or indirectly controls, is controlled by, or is under common control with the subject entity. “Control” means ownership or control of more than 50% of the voting rights of the subject entity, directly or indirectly.
“End User” refers to an individual approved by the customer to use the Service, for whom the Service has been ordered, and to whom the company (or our company at the customer’s request) has assigned a user ID and password. End Users include the customer’s employees, consultants, contractors, and agents, or third parties with whom the customer transacts, but are not limited to these groups.
“Our Company” refers to CM Plus Corporation.
“SFDC” refers to Salesforce.com, Inc.
“Customer Data” means all electronic data and information stored by the customer in the Service.
“Malicious Code” refers to viruses, worms, time bombs, Trojan horses, and other harmful or malicious code, files, scripts, agents, or programs.
2. Relationship with SFDC
The Service operates as an application integrated with the SFDC platform under the Salesforce OEM Partner Agreement. A separate agreement to the attached SFDC Service Agreement is required for the use of the SFDC platform integrated with the Service.
3. Services
3.1 Provision of Services
We will offer the Services to the Customer as a free trial for a limited period for one license. Additional trial conditions may be posted on the trial registration webpage. These additional conditions are incorporated into this agreement by reference and are legally binding.
3.2 Data in the Services
All data that you enter into the Services, and all customizations implemented by you or for you during your free trial period will be irretrievably deleted unless you export such data before the end of the trial period.
3.3 Consideration of Paid Services
During the trial period, please consider the paid services and make sure you fully understand their features and functionality before purchasing.
3.4 Purchase of Paid Services
If you wish to continue using the paid services after the trial period ends, you need to contact us and separately conclude the CORRESSA Service Terms of Use (for paid services). You can find the contact information for applying for paid services at http://www.corressa.com/.
4. Use of Services
4.1 Customer Responsibilities
The Customer shall bear the following responsibilities:
(i) Be responsible for ensuring compliance with the terms of this agreement by End Users.
(ii) Take full responsibility for the legality of Customer Data and the means by which the Customer acquired the Customer Data.
(iii) Make commercially reasonable efforts to prevent unauthorized access to or use of the Services, and promptly notify us upon discovery of any unauthorized access or use.
(iv) Use the Services solely in accordance with the User Guide and applicable laws and government regulations. The Customer shall not:
(a） Allow anyone other than End Users to use the Services.
(b) Sell, resell, rent, or lease the Services.
(c) Use the Services to store or transmit infringing, defamatory, or otherwise illegal or unlawful content, or content that infringes third-party privacy rights.
(d) Use the Services to store or transmit malicious code.
(e) Interfere with or disrupt the integrity or performance of the Services or third-party data contained therein.
(f) Attempt to gain unauthorized access to the Services or related systems or networks.
4.2 Usage Restrictions
The Services may be subject to restrictions, which are specified in the User Guide.
5. Customization by the Customer
For the Customer to create applications or objects for use with the Services, the Customer must meet the necessary requirements for the SFDC platform force.com that they use. Unless otherwise agreed, we do not guarantee the effectiveness or continuity of custom objects and APIs defined by the Customer, and we reserve the right to discontinue or modify them without notice. The Customer acknowledges and agrees to this possibility.
6. Software Updates
6.1 We periodically modify and add to the Services to address bugs and improve functionality. Updates may be applied and deployed through http://www.corressa.com/ or other websites specified in the User Guide.
6.2 Our principle is to provide services in accordance with these Terms on the latest version of the Services after updates. The Customer acknowledges that services under these Terms may not be provided for any old versions that have not been updated to the latest version.
6.3 Notwithstanding the previous section, the Customer agrees to acknowledge that software updates may impact on the Customer’s environment.
6.4 Addition of Services
6.4a After the conclusion of these Terms, any services indicated by us to be subject to these Terms, which the Customer agrees to, will be considered “Additional Services.” These form part of the Services and the right to use these services is included as part of the free trial.
6.4b Unless otherwise specified, these Terms apply to Additional Services.
7. Amendments to the Terms
7.1 Amendments
We may amend these Terms without obtaining the prior consent of the Customer.
7.2 Notification of Amendments
Amended Terms will be notified to the Customer by means deemed appropriate by us, including but not limited to displaying them on our website or sending notifications via email.
7.3 Consent to Amendments
If the Customer applies for or uses the Services after the Terms have been amended, it shall be deemed that the Customer has agreed to the amendments.
8. Proprietary Rights
8.1 Reservation of Rights
Subject to the limited rights expressly granted under these Terms, we reserve all rights, titles, and interests in and to the Services, including all related intellectual property rights. Except as expressly set forth in these Terms, no rights are granted to the Customer under these Terms.
8.2 Restrictions
The Customer shall not:
(i) Permit any third party to access the Services except as permitted herein,
(ii) Create derivative works based on the Services,
(iii) Copy, frame, or mirror any part or content of the Services, except for copying or framing on the Customer’s own intranets or otherwise for the Customer’s own internal business purposes,
(iv) Reverse engineer the Services,
(v) Access the Services for the purpose of:
(a) Building a competitive product or service,
(b) Copying any features, functions, or graphics of the Services.
8.3 Ownership of Customer Data
As between the Customer and us, the Customer exclusively owns all rights and interests in and to all Customer Data.
8.4 Suggestions
We shall have a royalty-free, worldwide, transferable, sublicensable, irrevocable, and perpetual license to use or incorporate into the Services any suggestions, enhancement requests, recommendations, or other feedback provided by the Customer (including End Users) regarding the operation of the Services.
9. Confidentiality
9.1 Definition of Confidential Information
As used in this agreement, “Confidential Information” means all confidential information disclosed by one party (the “Disclosing Party”) to the other party (the “Receiving Party”), whether orally or in writing, that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and the circumstances of disclosure. Customers’ Confidential Information includes Customer Data; our Confidential Information includes the Services. Each party’s Confidential Information includes the terms and conditions of this agreement, as well as business and marketing plans, technology and technical information, product plans and designs, and business processes disclosed by such party. However, Confidential Information (except for Customer Data) does not include information that:
(i) is or becomes publicly known without breach of any obligation owed to the Disclosing Party,
(ii) was known to the Receiving Party prior to its disclosure by the Disclosing Party without breach of any obligation owed to the Disclosing Party,
(iii) is received from a third party without breach of any obligation owed to the Disclosing Party,
(iv) was independently developed by the Receiving Party.
9.2 Protection of Confidential Information
Protection of Confidential Information. Unless otherwise permitted by the Disclosing Party in writing, (i) the Receiving Party shall use the same degree of care to prevent the disclosure or use of the Disclosing Party’s Confidential Information for purposes outside the scope of this agreement as it uses to protect its own confidential information, and (ii) the Receiving Party shall limit access to the Disclosing Party’s Confidential Information to those of its employees, contractors, and agents who need such access for purposes consistent with this agreement and who are bound by confidentiality obligations at least as protective as those in this section.
9.3 Protection of Customer Data
Notwithstanding the above, we will maintain appropriate administrative, physical, and technical safeguards to protect the security, confidentiality, and integrity of Customer Data. We will not (a) modify Customer Data, (b) disclose Customer Data except as compelled by law in accordance with Section 9.4 (Compelled Disclosure) or as expressly permitted in writing by the Customer, or (c) access Customer Data except to provide the Services, prevent or address service or technical problems, or at the Customer’s request in connection with customer support matters.
9.4 Compelled Disclosure The Receiving Party may disclose the Disclosing Party’s Confidential Information if compelled by law, provided the Receiving Party gives the Disclosing Party prior notice of the compelled disclosure (to the extent legally permitted) and reasonable assistance, at the Disclosing Party’s cost, if the Disclosing Party wishes to contest the disclosure. If the Receiving Party is compelled by law to disclose the Disclosing Party’s Confidential Information as part of a civil proceeding to which the Disclosing Party is a party, the Disclosing Party will reimburse the Receiving Party for its reasonable costs of compiling and providing secure access to such Confidential Information.
10. Warranties and Disclaimers
10.1 Warranties and Disclaimers
The Services are provided “as is,” and except as expressly stated in these Terms, neither party makes any warranties of any kind, whether express, implied, statutory, or otherwise. Each party specifically disclaims all implied warranties, including any implied warranties of merchantability or fitness for a particular purpose, to the maximum extent permitted by applicable law.
11. Limitation of Liability
11.1 Disclaimer of Consequential and Related Damages
In no event shall either party have any liability to the other for any lost profits or revenues or for any indirect, special, incidental, consequential, cover, or punitive damages, however caused, whether in contract, tort, or under any other theory of liability, and whether or not the party has been advised of the possibility of such damages. This disclaimer shall not apply where prohibited by applicable law.
12. Term and Termination of the Services
12.1 Term of the Services
These Terms come into effect on the date the Customer accepts them and will remain in effect until the expiration or termination of the free trial period granted under this agreement, or until a subscription purchased under separate CORRESSA Services Agreement (paid services) comes into effect.
12.2 Termination
We may discontinue providing the Services if: (i) the other party is notified in writing of a material breach and fails to cure such breach within the specified period, or (ii) the other party becomes the subject of a petition in bankruptcy or any other proceeding relating to insolvency, receivership, liquidation, or assignment for the benefit of creditors. No termination procedures are necessary on the part of the Customer upon expiration of the Services because we will not automatically convert to paid services without the Customer’s consent.
12.3 Survival
Sections 8 (Proprietary Rights), 9 (Confidentiality), 10 (Warranties and Disclaimers), 11 (Limitation of Liability), and 13 (General Provisions) shall survive any discontinuation or expiration of the Services.
13. General Provisions
13.1 Exclusion of Anti-Social Forces
Both parties represent and warrant the following: (i) They themselves are not anti-social forces, (ii) They have not been anti-social forces, (iii) They do not use anti-social forces, (iv) Their officers are not anti-social forces and do not have relationships with anti-social forces, and (v) Those who control their financial and business policies are not anti-social forces and do not have relationships with anti-social forces.
13.2 Compliance with Export Laws
Each party shall comply with export laws of Japan, the United States, and other countries where the Services are provided or used.
13.3 Relationship of the Parties
The parties are independent contractors. This agreement does not create a partnership, franchise, joint venture, agency, fiduciary or employment relationship between the parties.
13.4 Notices
Except as otherwise specified in these Terms, all notices, permissions, and approvals under these Terms shall be in writing and shall be deemed to have been given: (i) upon personal delivery, (ii) two business days after mailing, (iii) two business days after sending by confirmed fax, or (iv) one business day after sending by email. However, email shall not be sufficient for notices of material breach or an indemnifiable claim. Notices to the Customer from us will be sent either posted on our website or sent to the system administrator designated by the Customer for the Services. Notices to us should be sent by the method we designate to the address we specify.
13.5 Changes to Registration Details
The Customer shall promptly report changes to any details provided at the time of application for the Services through our specified online method.
13.6 Severability
If any provision of this agreement is held by a court of competent jurisdiction to be contrary to law, the provision shall be modified by the court and interpreted so as best to accomplish the objectives of the original provision to the fullest extent permitted by law, and the remaining provisions of this agreement shall remain in effect.
13.7 Governing Law
This agreement and any disputes arising out of or in connection with it shall be governed by the laws of Japan, without regard to its conflict of laws principles.
13.8 Jurisdiction
The Tokyo District Court or the Tokyo Summary Court shall have exclusive jurisdiction for the first instance to resolve any disputes arising out of or in connection with this agreement, following the claim amount and the plaintiff’s choice.
13.9 Entire Agreement
This agreement, including all its schedules and attachments, constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter. Any amendment, change, or waiver of any provision of this agreement shall be effective only if in writing and signed or electronically accepted by the party against whom the amendment, change, or waiver is to be asserted. In the event of any inconsistencies or conflicts between the body of this agreement and its schedules or attachments, the terms of the schedules or attachments shall prevail.

Attachment 1. SFDC Services Agreement
“AppExchange” refers to the online directory of applications that interact with the SFDC Services, posted on https://appexchangejp.salesforce.com/ or any successor website.
“Customer Data” refers to all electronic data or information stored by the customer in the Platform or SFDC Services and existing within the Platform or SFDC Services.
“The Platform” refers to the online, web-based platform services provided by SFDC to the Partner in connection with the Partner’s provision of the Partner Application to customers.
“The Partner” refers to CM Plus Corporation.
“The Partner Application” refers to CORRESSA.
“The SFDC Services” refers to the online, web-based services provided to the public via http://www.salesforce.com/jp or other designated websites, and includes related offline components, but excludes applications from AppExchange. In this SFDC Services Agreement, the SFDC Services do not include the Platform.
“SFDC” refers collectively to Salesforce.com, Inc. and its affiliates.
“The Third-Party Applications” refer to the online, web-based applications and online software products made available by third parties and identified as third-party applications, including those contained in AppExchange and the Partner Application, but not limited to them.
“Users” refer to the customer’s employees, representatives, consultants, contractors, agents, or third parties who conduct business with the customer and are authorized by the customer to use the Platform in accordance with the terms set forth in the SFDC Services Agreement as a result of a subscription purchased for the Partner Application on their behalf, and to whom a user ID and password have been supplied by the customer (or by SFDC or the Partner at the customer’s request).
“Customer” or “Client” refers to any person or entity that has entered into a contract to purchase a subscription to use the Partner Application in accordance with the terms set forth in the SFDC Services Agreement, together with any other terms required by the Partner.
1. Use of the Platform
(a) Each User Subscription of the Partner Application grants one User the right to use the Platform via the Partner Application, in accordance with the terms set forth in the SFDC Services Agreement along with any other conditions required by the Partner. User Subscriptions cannot be shared or used by more than one User; however, they may be reassigned to new Users replacing former Users who no longer need to use the Platform due to the termination of their employment with the Customer or changes in position or job function. For clarification, subscriptions used by the Customer to use the Platform under this Agreement do not generally include the SFDC Services, nor do they cover subscriptions used in connection with applications other than the Partner Application. If the Customer wishes to access SFDC Services features or services beyond those included in the SFDC Services or the Partner Application, or create or use additional custom objects beyond those accessible in the form of the Partner Application provided to the Customer, the Customer should contact SFDC directly by visiting www.salesforce.com/jp. If accessing the Partner Application allows the Customer to access the broader SFDC Services or any SFDC Services functionality within the Partner Application beyond what is documented in the User Guide for the Platform or the Partner Application, and if the Customer has not subscribed to such access under a separate agreement with SFDC, the Customer agrees not to access or use such functionalities. The Customer’s use of such functionalities or creation or use of additional custom objects beyond those accessible in the provided form of the Partner Application will constitute a material breach of this Agreement.
(b) If the Customer’s subscription for using the Platform under this Agreement includes Salesforce Mobile, the Customer agrees to review the list of supported mobile devices posted at http://www.salesforce.com/mobile/devices/ before purchasing Salesforce Mobile. The Customer agrees that they will not be entitled to any refunds, credits, or other compensation or remedies from SFDC if purchasing Salesforce Mobile for a mobile device that is not supported by SFDC. Third-party providers offering mobile devices, operating systems, and network connections can discontinue, interrupt, uninstall, or decommission access to Salesforce Mobile on supported mobile devices without providing the Customer any rights to refunds, credits, or other compensation or remedies, at any time.
(c) Even if the Customer can access the Platform or SFDC Services via the Partner Application, the Partner remains the sole provider of the Partner Application, and the Customer is in a contractual relationship only with the Partner. SFDC is not obliged to provide the Partner Application or refund any fees that the Customer has paid to the Partner if the Partner ceases operations or is otherwise unable to provide the Partner Application.
(d) The Customer shall (i) be responsible for all activities that occur under the Customer’s User accounts, (ii) be responsible for the content of all Customer Data, (iii) make commercially reasonable efforts to prevent unauthorized access to or use of the Platform or SFDC Services, and notify the Partner or SFDC promptly upon any unauthorized use, and (iv) comply with all applicable local, state, federal, and foreign laws in using the Platform.
(e) The Customer shall use the Platform and SFDC Services solely for its internal business purposes and shall not (i) license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, time share, or otherwise commercially exploit or make the Platform or SFDC Services available to any third party, other than Users or as contemplated by this SFDC Services Agreement; (ii) send spam or otherwise duplicative or unsolicited messages in violation of applicable laws; (iii) send or store infringing, obscene, threatening, libelous, or otherwise unlawful or tortious material, including material harmful to children or violative of third-party privacy rights; (iv) send or store material containing viruses, worms, time bombs, Trojan horses, or other harmful or malicious codes, files, scripts, agents, or programs; (v) interfere with or disrupt the integrity or performance of the Platform or SFDC Services or the data contained therein; or (vi) attempt to gain unauthorized access to the Platform or SFDC Services or their related systems or networks.
(f) The Customer shall not (i) modify, copy, or create derivative works based on the Platform or SFDC Services; (ii) frame or mirror any content forming part of the Platform or SFDC Services, except on the Customer’s own intranets or otherwise for its own internal business purposes; (iii) reverse engineer the Platform or SFDC Services; or (iv) access the Platform or SFDC Services in order to (a) build a competitive product or service, or (b) copy any ideas, features, functions, or graphics of the Platform or SFDC Services.
2. Third-Party Providers
The Partner and other third-party providers (which may be listed on the SFDC website and include providers of Third-Party Applications) offer products and services related to the Platform, SFDC Services, and Partner Application. Such products and services include implementation, customization, and other consulting services related to the use of applications (including both offline and online) that interact with the Platform or SFDC Services, facilitate data exchange between the Platform or SFDC Services, or offer additional functionality within the user interface of the Platform or SFDC Services through the use of application programming interfaces. SFDC makes no warranty regarding such third-party providers or their products or services, regardless of whether SFDC has certified, approved, or otherwise designated them (including Partner Applications or other products or services of the Partner, but not limited to these). Any exchange of data or other interaction between the Customer and third-party providers (including but not limited to Partner Applications), as well as any purchase of products or services from such third-party providers by the Customer (including but not limited to Partner Applications), is solely between the Customer and the third-party provider. Furthermore, SFDC or the Partner may, from time to time, offer certain additional functionality (not defined as part of the Platform or SFDC Services) to the Customer on a pass-through or OEM basis, subject to separate terms specified by the licensor and agreed to by the Customer, in connection with a separate purchase of such additional functionality. The Customer’s use of such additional functionality will be subject to those terms, and in the event of any conflict with the SFDC Services Agreement, those terms will take precedence.
3. Integration with Third-Party Applications
If the Customer installs or enables a Third-Party Application for use with the Platform or SFDC Services, and it is necessary for the interoperability of the Platform or SFDC Services with such Third-Party Application, the Customer agrees that SFDC may allow the provider of the Third-Party Application to access the Customer Data as required for such interoperability. SFDC shall not be responsible for any disclosure, modification, or deletion of Customer Data resulting from such access by the provider of the Third-Party Application. Additionally, the Platform and SFDC Services may contain features designed to interoperate with Third-Party Applications (e.g., Google, Facebook, or Twitter applications). To use such features, the Customer may be required to obtain access rights from the providers of such Third-Party Applications. If such a provider ceases to make the Third-Party Application available for interoperation with the corresponding features of the Platform or SFDC Services on reasonable terms, SFDC may cease providing such features of the Platform or SFDC Services without entitling the Customer to any refund, credit, or other compensation.
4. Access by the Partner
As long as the Partner serves as the administrator of the Partner Application on behalf of the Customer, the Customer acknowledges that the Partner can monitor the Customer’s use of the Partner Application and access Customer Data stored in the SFDC Services or Partner Application. By agreeing to the SFDC Services Agreement, the Customer consents to such monitoring and access by the Partner.
5. Return of Customer Data
The Customer may request a copy of the Customer Data within 30 days of the termination date of the Customer’s subscription to the Partner Application, and such a copy shall be created in CSV format. If Customer Data is modified outside the Platform by the Partner Application, all such modified Customer Data will not be included in the returned Customer Data, and the return of all such modified data shall be the responsibility of the Partner.
6. Proprietary Rights
Subject to the limited rights expressly granted under this Agreement, SFDC reserves all rights, title, and interest (including all related intellectual property rights) in and to the Platform and SFDC Services. SFDC does not grant the Customer any rights other than as expressly set forth in this SFDC Services Agreement. The Platform and SFDC Services are considered SFDC’s confidential information, and the Customer shall not use or disclose it to any third party except as permitted by the SFDC Services Agreement.
7. Compelled Disclosure
If either the Customer or SFDC is compelled by law to disclose the other party’s confidential information, they shall provide the other party with prior notice of such compelled disclosure to the extent legally permitted, and reasonable assistance at the other party’s expense if the other party wishes to contest the disclosure.
8. Suggestions
The Customer agrees that SFDC shall have a royalty-free, worldwide, transferable, sublicensable, irrevocable, perpetual license to use or incorporate into SFDC products or services any suggestions, enhancement requests, recommendations, or other feedback provided by the Customer or its Users related to the operation of the Platform and SFDC Services.
9. Suspension and Termination
The Customer’s use of the Platform and SFDC Services may be terminated or suspended immediately upon notice for any of the following reasons: (a) a breach of the SFDC Services Agreement by the Customer or any of its Users, (b) termination or expiration of the agreement between the Partner and SFDC concerning the Platform provided as part of the Partner Application, (c) a breach by the Partner of its obligations to SFDC related to the subscription provided to the Customer in connection with the SFDC Services Agreement. If the Customer uses the Partner Application in combination with an SFDC Services organization not provisioned solely for use with the Partner Application, the Customer acknowledges and agrees that (i) access to such organization (including the Partner Application used in connection with it) may be suspended due to the Customer’s failure to pay or other breaches related to the agreement between the Customer and SFDC, and (ii) if the relationship between the Customer and SFDC is terminated due to the Customer’s failure to pay or other significant breaches related to the agreement between the Customer and SFDC, the subscription to the Platform will also terminate. SFDC shall not be liable to the Customer for any refund or other compensation as a result of such termination or suspension.
10. Non-Cancelable Subscription
The subscription to the Platform is non-cancelable during the term of the subscription, except as otherwise provided in the Customer’s agreement with the Partner.
11. Disclaimer of Warranties
SFDC makes no warranties of any kind, whether express, implied, statutory, or otherwise, including, but not limited to, those related to the Platform, SFDC Services, and Partner Application. To the maximum extent permitted by law, SFDC disclaims all conditions, representations, and warranties, whether express, implied, statutory, or otherwise, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights regarding the Platform, SFDC Services, and Partner Application.
12. Limitation of Liability
SFDC shall not be liable to the Customer or any User for any damages whatsoever. Such damages include, but are not limited to, direct, indirect, special, incidental, punitive, or consequential damages, or damages based on lost profits, regardless of the cause, and regardless of whether the damages arise from contract, tort, or any theory of liability, and regardless of whether the Customer has been informed of the possibility of such damages.
13. Additional Communication
SFDC may contact the Customer regarding new features and offerings related to the Platform and SFDC Services.
14. Third-Party Beneficiary
SFDC shall be a third-party beneficiary to the agreement between the Customer and the Partner only with respect to the SFDC Services Agreement.
15. Applicability
The terms of the SFDC Services Agreement apply to the Platform provided by the Partner to the Customer in connection with the provision of the Partner Application by the Partner. For the avoidance of doubt, the terms of the SFDC Services Agreement do not take precedence over any agreement between SFDC and the Customer regarding SFDC Services that the Customer has purchased directly from SFDC.
